1. Acceptance of Terms
By accessing or using MyClaw Home (hihiclaws.com) and related services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the service. If you use the service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Service Description
MyClaw Home (hihiclaws.com) provides only the following: version releases and documentation for open-source software, a guided coordination interface for deploying MyClaw instances, and an open-source community directory. hihiclaws.com does NOT provide AI inference, data storage, or Cloudflare account management services. All AI capabilities and data storage are provided by the user's own deployed MyClaw instance, running on the user's own Cloudflare account.
3. Account and Access Requirements
Using MyClaw requires a valid Cloudflare account and agreement to Cloudflare's Terms of Service (cloudflare.com/terms). You are responsible for maintaining the security of your Cloudflare account credentials. MyClaw is not liable for any losses resulting from account compromise. Your deployed MyClaw instance is treated as an application under your Cloudflare account, for which you bear full responsibility.
4. User Responsibilities
You agree to: (1) comply with all applicable laws and regulations and Cloudflare's Terms of Service; (2) take responsibility for all content generated by your deployed MyClaw instance; (3) ensure that any third-party AI API Keys you use comply with those providers' terms; (4) not use the service for any illegal, fraudulent, or infringing purposes; and (5) indemnify MyClaw and its contributors against any claims or losses caused by your use of the service.
5. Prohibited Activities
The following are strictly prohibited: (1) using the service for any illegal purpose; (2) distributing spam, malware, or harmful content through the service; (3) launching attacks against MyClaw infrastructure or any third-party system; (4) reverse engineering the software (except as permitted by the MIT License for research purposes); (5) impersonating MyClaw officials or fabricating official communications; (6) attempting to circumvent any security mechanisms of the service; (7) using the service to infringe on others' copyrights, trademarks, or intellectual property; (8) automated mass abuse of MyClaw Home's coordination service (e.g. malicious scraping).
6. AI Content Disclaimer
MyClaw integrates AI models (including Cloudflare Workers AI and BYOK external APIs) to provide intelligent features. Important disclaimers: (1) AI-generated content does not represent the views of MyClaw, its administrators, or contributors; (2) AI may produce inaccurate, incomplete, outdated, or inappropriate content ("hallucinations") — we make no warranty regarding this; (3) AI-generated content does not constitute legal, medical, financial, or other professional advice; (4) Users are responsible for verifying the accuracy of AI output and making their own judgments; (5) MyClaw is not liable for any losses resulting from reliance on AI-generated content.
7. Intellectual Property
MyClaw source code is open-source under the MIT License (github.com/myclaw). The MIT License permits you to freely use, copy, modify, merge, publish, distribute, sublicense, and sell copies of the software, provided that the original copyright notice is retained. The "MyClaw" brand name, logo, and visual identity are protected by trademark and may not be used for unauthorized commercial purposes or in ways likely to cause confusion. Contributors retain copyright in their contributions, but grant usage rights under the MIT License.
8. Disclaimer of Warranties (AS-IS)
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED SERVICE, ERROR-FREE OPERATION, OR DATA ACCURACY. MYCLAW, ITS ADMINISTRATORS, CONTRIBUTORS, AND PARTNERS EXPRESSLY DISCLAIM ALL SUCH WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THE INVALIDITY OF ANY PART OF THIS DISCLAIMER DOES NOT AFFECT THE REMAINING PROVISIONS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYCLAW AND ITS ADMINISTRATORS, CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR REPUTATIONAL DAMAGE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF APPLICABLE LAW DOES NOT ALLOW FULL EXCLUSION OF LIABILITY, MYCLAW'S MAXIMUM CUMULATIVE LIABILITY SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM (OR $1.00 USD IF NO FEES WERE PAID).
10. Indemnification
You agree to indemnify, defend, and hold harmless MyClaw's administrators, contributors, licensors, and their respective agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (1) your violation of these Terms; (2) your violation of any applicable law or third-party terms of service; (3) content generated by your MyClaw instance that infringes third-party rights; or (4) your willful misconduct or negligence.
11. Service Availability and Interruptions
MyClaw Home does not guarantee 100% service uptime. Service may be interrupted due to: Cloudflare infrastructure maintenance or outages, planned maintenance (we will endeavor to provide advance notice), or force majeure events beyond our control (natural disasters, government orders, third-party service outages, etc.). MyClaw is not liable for any losses resulting from service interruptions. Users relying on the service for critical applications are advised to implement appropriate redundancy measures.
12. Termination
You may stop using MyClaw Home at any time; deleting your Cloudflare resources terminates your MyClaw instance. MyClaw reserves the right to terminate or suspend your access to the service without prior notice if: you violate these Terms, your use harms other users or the infrastructure, or required by law. Upon termination, provisions that by their nature should survive (including disclaimers, limitation of liability, and indemnification) shall continue to apply.
13. Service Operator & Manager Protection
In these Terms, "MyClaw" includes but is not limited to: Service Operators, Service Managers, system administrators, platform maintainers, developers, open-source contributors, and their respective agents and successors. The following protections apply: (1) Operators and managers provide this service on a voluntary or commercial basis and assume no obligations beyond those expressly stated in these Terms; (2) Operators and managers have no obligation to review, monitor, or intervene in the content, data, or behavior within user-deployed MyClaw instances; (3) Operators and managers have no obligation to mediate or adjudicate disputes between users or between users and third parties; (4) Actions taken by operators and managers in good faith to enforce these Terms (including suspension or termination) do not constitute breach of contract or tort; (5) Operators and managers are not liable for service interruptions, errors, or policy changes by Cloudflare, third-party AI providers, or other infrastructure suppliers; (6) Technical decisions made by operators and managers for security, legal compliance, or operational needs (including but not limited to version updates, feature modifications, security patches) are deemed reasonable business judgment, and users may not claim damages therefor; (7) Sections 8 (Disclaimer), 9 (Limitation of Liability), and 10 (Indemnification) apply to all operators and managers individually and may be independently invoked.
14. Governing Law
The interpretation and enforcement of these Terms is governed by applicable local law. If you are located in the EU, GDPR and related consumer protection laws apply. Users in each jurisdiction are responsible for complying with their locally applicable laws and regulations. MyClaw is not liable for compliance issues arising from jurisdictional differences.
15. Dispute Resolution
In the event of any dispute arising from these Terms or the service, the parties shall first attempt in good faith to resolve it through negotiation (contact hello@hihiclaws.com, with "Dispute" in the subject line). If no resolution is reached within 30 days, both parties agree to seek arbitration before a competent arbitral body. During dispute resolution, you may not bring personal legal actions against individual MyClaw contributors.
16. Severability
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or deleted if it cannot be modified, while the remaining provisions continue in full force and effect. The invalidity of any single provision does not affect the validity of the Terms as a whole.
17. Entire Agreement
These Terms constitute the entire agreement between you and MyClaw regarding the service and supersede all prior agreements, promises, representations, or understandings on the same subject. Any waiver of these Terms must be in writing and signed by a MyClaw administrator to be valid.
18. Changes to Terms Notification
We may update these Terms as the service evolves, due to legal requirements, or business changes. Material changes will be communicated via: a GitHub repository announcement (at least 14 days in advance), a prominent notice on the hihiclaws.com homepage, and email to users who have subscribed to notifications. Continued use of the service constitutes acceptance of the updated Terms. For material adverse changes, you have the right to stop using the service before they take effect.
